Kumasi SHS Asst. Head Wins Case Against GES Over Gay Allegation

The suspended Assistant Headmaster of the Kumasi High School, George Amponsah-Duodo, who has been accused of sodomizing some students of the school, has won a judicial revew case against the Director-General of Ghana Education Service [GES].

High Court Judge, Her Ladyship Georgina Mensah-Datsa thrown out the allegation of the Education Service after a judicial review in the nature of certiorari to quash portions of the investigation report of the respondent on grounds of non-compliance with the rules of natural justice.

According to the court, George Amponsah-Duodo “was not given a hearing” – and that “It was contended that the action is premature as the applicant would have been given a hearing before the disciplinary committee.”

Assistant headmaster of KUHIS suspended over sodomy allegations

George Amponsah-Duodo was suspended, pending investigations into allegations of sodomy against him.

The 54-year-old Assistant Headmaster at Kumasi High School (KUHIS), was accused of engaging in the alleged acts with students of the all-male school.

The Regional Education Directorate referred the matter to the Disciplinary Committee for further investigations.

A letter signed by Regional Director, Mary Owusu Achiaw, to the Ghana Education Service (GES) Council says the action follows accusation by alleged victims.

The Ashanti Regional Education Directorate, asked Mr. Amponsah-Duodu to step aside pending completion of the process.

Regional Education Director, Mary Owusu Achiaw, issued the directive by a letter dated November 4, 2018, and copied the Chairman of GES Council, Director-General of GES and Metropolitan Director of Education as well as Headmaster and Board Chairman of Kumasi High School.

George Amponsah-Duodo after his suspension sued the GES after describing the allegations as “baseless” in a letter from his lawyers; Mr. Amponsah-Duodo said he was not given fair hearing by the school’s disciplinary committee.

According to his lawyers, the committee investigating the allegations has been “necessitated merely by hearsay or some assertion without any concrete documentary or evidential proof.”

Mr. Amponsah-Duodo’s lawyers argued that the second respondent, who is the headmaster of the school refused to produce the student who made the allegation against their client for interrogation.

“The 2nd respondent’s committee neither showed me any complaint or a statement written by the student nor the name if the student,” the writ read.

Court ruling

However, the court on Thursday, January 31st 2019 has ordered GES to nullify portions of the adverse findings on George Amponsah-Duodo.

The court has also ordered a sum of GHC5, 000.00 to be awarded to Mr Amponsah-Duodu.
